Abstract

This article focuses on the legal implications arising from the growing adoption of artificial intelligence (AI) in various sectors of Brazilian society, with a focus on identifying and evaluating possible discrimination present in these systems. The research investigates how artificial intelligence may be reproducing and perpetuating biases and their consequences when using a legal and interdisciplinary approach. The due study employs exploratory approach methods through the analysis of scientific articles, as well as official documents related to artificial intelligence to investigate the problem, in addition to bibliographic review and case studies to understand the legal dynamics associated with AI. The qualitative results reveal a complex interplay between existing legislation and technological advances, highlighting gaps and challenges in regulation. Furthermore, there is a need for adaptations to Brazilian laws to effectively deal with issues related to responsibility, privacy, and algorithmic discrimination. It is concluded that the ethical and effective implementation of AI requires a comprehensive review of legislation, promoting harmony between technological innovation and the protection of fundamental rights in the Brazilian context. This work contributes to understanding the legal implications of AI in Brazil and suggests ways to improve regulation and promote sustainable technological development.

Advogada, mestre em Ciências do Consumo, LLM em proteção de dados com dupla certificação: Brasil e Portugal, professora em diversas pós-graduações em Direito Digital e Proteção de Dados. Coautora e coordenadora de obras jurídicas com artigo e livros indicados nas bibliografias selecionadas pelo STJ. Conselheira estadual da OAB/PE e presidente da Comissão de Proteção de Dados da OAB/PE e de Crimes cibernéticos da ABCCRIM.

Gabriela Lima Barreto

Advogada e Mestranda em Direito e Negócios Internacionais pela Universidad Europea Del Atlántico, graduanda em Ciências Contábeis. Especialista em Direito Constitucional, Direito Tributário e Direito Público, Coordenadora de pós-graduações nacionais e internacionais. Professora, palestrante e pesquisadora na área de Direito e Novas Tecnologias, participação como coordenadora e/ou coautora em mais de 30 obras e revistas jurídicas nacionais e internacionais, cujos artigos são citados nas bibliografias selecionadas pelo Superior Tribunal de Justiça (STJ) e Conselho Nacional de Justiça (CNJ).
